Terms of service

1. The agreement
By creating an account you agree to these terms. If you are agreeing on behalf of a company, you confirm you have the authority to bind it.
2. What the service does
CheckMySites fetches a public web page you specify, analyses it across ten categories, and produces a scored report with recommendations.
The service is provided on a subscription basis with a monthly audit allowance. There is no free tier.
3. What you may audit
You may audit any publicly accessible website. You agree not to use the service to:
- Attempt to reach systems you are not authorised to access, including internal hostnames, private IP ranges and cloud metadata endpoints. These are blocked, and circumventing that block is a breach of these terms.
- Generate load intended to degrade a third party's service.
- Resell raw API access, or present the service as your own product, except through white-label reporting on a plan that includes it.
- Circumvent quota, rate limiting or access controls.
We may suspend an account we reasonably believe is being used this way. Where practical we will tell you first.
4. What an audit is and is not
This section matters more than the rest, so it is written plainly.
An audit is an automated analysis of one page at one moment. It is not a security assessment, a legal compliance certification, or a guarantee about search rankings.
- Accessibility findings are not a compliance certificate. Automated tools detect a meaningful subset of WCAG issues. They cannot judge whether alt text is accurate, whether a page is genuinely operable by assistive technology, or whether your organisation meets its legal obligations. Passing our checks does not mean you comply with the ADA, the Equality Act, the European Accessibility Act or any other law.
- Security checks are passive and partial. We read response headers, inspect your certificate and look at page source. We perform no penetration testing. A clean security score does not mean your site is secure.
- SEO findings do not guarantee rankings. Search engines weigh hundreds of factors we cannot observe, and change them without notice.
- Scores are our opinion. The weights and thresholds reflect our judgement about what matters commercially. They are documented and consistent, not objective truth.
Use a report as informed input to your own decisions, not as a substitute for professional advice.
5. Billing
- Plans are billed monthly in advance, in US dollars.
- Your audit allowance resets at the start of each billing period. Unused audits do not roll over.
- Upgrades take effect immediately with the new allowance available straight away. Downgrades take effect at the end of the current period.
- You may cancel at any time and keep access until the end of the period you have paid for.
- A failed audit — one where we could not reach the site — does not consume an audit from your allowance.
6. Who owns what
You own your reports. The findings we generate about your site are yours to use, publish, share with clients and resell as part of your own services.
We own the service. The software, the audit engine, the scoring model and the brand remain ours. Nothing here transfers any of it to you.
We may use aggregate, anonymised statistics — for example “38% of audited sites block AI retrieval crawlers” — in published research. This never identifies you or your sites.
7. Availability
We aim for high availability but do not offer a contractual uptime guarantee on standard plans. The service may be unavailable for maintenance, or because a dependency we rely on is down.
8. Liability
The service is provided “as is”. To the maximum extent permitted by law, our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose.
We are not liable for indirect or consequential loss, including lost profits, lost traffic or lost rankings.
Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud. If you are a consumer, your statutory rights are unaffected.
9. Ending it
You may close your account at any time. We may terminate an account that breaches these terms, or with 30 days' notice for any other reason, refunding any unused portion of the period you have paid for.
10. Changes
We may update these terms. Material changes will be emailed to account holders at least 14 days before taking effect. Continuing to use the service after that constitutes acceptance.
